What Is Sexual Misconduct?

Sexual harassment (whether opposite-sex or same-sex) is strictly prohibited under DCCC Sexual Harassment Policy. Examples of the types of behavior that are considered sexual harassment in violation of this policy include: 

  • Sexually offensive jokes or comments
  • Physical assaults or other touching that is sexual in nature 
  • Promising favorable treatment or threatening unfavorable treatment based on the student’s or employee’s response to sexual demands
  • Displays of sexually oriented reading materials or pictures, including electronic material
  • Punishing a student or employee for complaining of sexual harassment

Sexual Violence is prohibited under the DCCC Campus SaVE Act Policy (Sexual Violence Elimination Act). DCCC policy forbids domestic violence, dating violence, sexual assault, and stalking. The office on women’s Health in Washington DC provides examples of those terms:

Sexual assault or abuse is any type of sexual activity that a person does not agree to, including:

  • Rape or attempted rape
  • Touching your body or making you touch someone else's
  • Incest or sexual contact with a child
  • Someone watching or photographing you in sexual situations
  • Someone exposing his or her body to you

Dating and domestic violence includes:

  • Physical abuse like hitting, shoving, kicking, biting, or throwing things
  • Emotional abuse like yelling, name-calling, bullying, embarrassing, keeping you away from your friends, saying you deserve the abuse, or giving gifts to "make up" for the abuse
  • Sexual abuse like forcing you to do something sexual (such as kissing or touching) or doing something sexual when you cannot agree to it (like when you are very drunk)

Stalking includes:

  • Following or spying on you
  • Sending you unwanted emails or letters
  • Calling you often
  • Showing up at your house, school, or work
  • Leaving you unwanted gifts

 

What You Need to Know About Sexual Harassment and Sexual Violence

You are not alone. If you, or someone you care about, have been impacted by sexual misconduct, the most important thing to know is that you are not alone – there are people who can and want to help. People are available to listen, offer support, provide options, and take actions to help ensure that you and our community are safe. Survivors of sexual misconduct respond to their experiences in different ways. There is no 'right way' to feel or 'right thing' to do. This pamphlet contains information to think about as you decide what is right for you. Remember, you are not alone. Davidson County Community College is here to help.

How can you help? If you observe sexual harassment or assault, intervene safely. Take care of your friends when you are out with acquaintances or strangers. Don't let friends be taken advantage of. Don't accept or let your friends accept drinks from others you are not sure you can trust. Don't blame victims or let others blame victims by saying he or she is at fault for acting or dressing this or that way. Be emphatic with friends that consent for sexual interactions needs to be clear and explicit. Don't support the idea that not fighting back or that just being quiet is consent. If you know someone who has been assaulted don't make decisions for him or her but help them identify resources and options available Consider the humiliation, embarrassment, or fear you might experience if you were the object of rude or vulgar language. Take care with your own speech. Talk with friends about other ways to prevent sexual assault or harassment.

 

Reporting Harassment or Assault

Several options are available to you to report Sexual Harassment or Assault.

Title IX Coordinator: Reports can be made to the Title IX Coordinator & Compliance Officer, Karen Boyd. Reports received will be investigated to the extent possible, determining subsequent action.

Campus Officer/Security: Reports will be shared with the Title IX Coordinator and relevant College administrators and investigated to the extent possible, determining subsequent action.

Vice President, Student Affairs: Reports will be shared with the Title IX Coordinator and investigated.

Student Affairs – Director of Student Conduct and Community Standards: If the person who caused the harm is a student, you may request that investigation and action be taken through the College student conduct process. The Title IX Coordinator will be fully informed.

College staff, faculty or administrator: Reports will be shared with the Title IX Coordinator and investigated.

Police: If you would like to make a police report immediately following an assault, dial 911. The College will also assist in contacting the police if you so desire.

Counselor / Public Health Nurse: Reports made to the campus mental health counselor, the disability counselor, and/or Public Health Nurse will be confidential. A report to one of these persons is not a report to the College and will only be investigated if you so desire.

Please note any report of sexual misconduct received by any College staff, faculty, or administrator who is not a Confidential Resource will be shared with the Title IX Coordinator. The Title IX Coordinator will review and respond promptly to all reports to ensure safety and provide appropriate campus response.


What to Expect

If you decide to report to campus officials, you can expect the following:

Privacy Protection: Your privacy will be protected to the greatest extent possible. Information may be shared with certain College professionals to ensure safety and/or provide accommodations.

Support and Safety Accommodations: Accommodations including: no contact or restraining orders, modifications to academic or work schedules will be offered to prevent further contact between you and the person who harmed you.

Interviews Conducted: To gather information about the incident, individual interviews will be conducted with you, the person who harmed you, and any identified witnesses. The standard for determining responsibility for a violation of policy is "it is more likely than not that the violation occurred."

No Retaliation: Any attempt to intimidate, threaten retaliation, or otherwise attempt to prevent the reporting of an incident – or participation in a conduct process – is prohibited. Anyone who is intimidated or threatened in any way should report concerns to the Title IX Coordinator or the Campus Resource Officer.

Support Person Available: Both parties involved have the right to have a support person of their choice present during the interviews.

Notification of Findings: Both parties will be informed of the outcome of any investigation, disciplinary hearing process, and sanctions imposed.

 

Personal Safety

If you are in immediate danger, call 911. If you are concerned for your safety, and would like assistance in establishing a safety plan such as an escort to your car, the Campus Safety Office or the mental health counselor can help you explore your options.

 

Emotional Support

If you would like to speak with someone who might be able to help you make decisions and begin to heal, the campus mental health counselor or Davidson County Family Services offer free, confidential, individual counseling.

 

Medical Care

If you have been sexually assaulted or physically harmed, consider seeing a health-care provider to treat any injuries and discuss possible pregnancy concerns and/or sexually transmitted infections.

The Thomasville Hospital provides low-cost STI and pregnancy testing, treatment for injuries, and can assist with referrals.

 

Evidence Collection

If you have been sexually assaulted and might want to press charges, it is ideal to have forensic evidence collected at Thomasville Hospital emergency room.

To preserve evidence, it is best to not change clothes or shower. If you do remove clothing, place them in a paper (not plastic) bag. If oral contact took place, try not to smoke, eat, drink, or brush your teeth until evidence can be collected.
